Welcome to ClearLevel.in. These Seller & Educator Terms and Conditions govern the use of the ClearLevel platform by teachers, educators, coaching institutes, publishers, authors, employers, and other sellers who wish to list, market, or sell educational products and services through ClearLevel.
By registering as a seller on ClearLevel, you agree to be bound by these Terms.
1. Eligibility
To sell on ClearLevel, you must:
Be at least 18 years of age.
Have the legal authority to enter into a binding agreement.
Provide accurate personal, business, banking, and tax information.
Comply with all applicable laws and regulations.
ClearLevel reserves the right to approve, reject, suspend, or terminate any seller account at its sole discretion.
2. Products and Services Allowed
Sellers may offer:
Online courses
Recorded lectures
Live classes
E-books
Study materials
Test series
Mock tests
Educational software
Academic resources
Career and professional development services
ClearLevel may restrict or prohibit certain categories at its sole discretion.
3. Content Ownership
The seller retains ownership of their original content.
By uploading content to ClearLevel, the seller grants ClearLevel a non-exclusive, worldwide, royalty-free license to:
Display
Promote
Market
Distribute
Host
Sell
the listed products and services through the platform.
4. Intellectual Property
The seller warrants that:
All uploaded content is owned by the seller or properly licensed.
No content infringes copyrights, trademarks, patents, or other intellectual property rights.
The seller has obtained all required permissions for third-party content.
ClearLevel reserves the right to remove any content that may violate intellectual property laws.
5. Prohibited Content
The following content is strictly prohibited:
Pirated courses
Copyright-infringing materials
Unauthorized recordings
False claims or misleading advertisements
Offensive, defamatory, or illegal content
Malware, malicious software, or harmful files
Content promoting academic dishonesty or examination fraud
Violation may result in immediate account termination.
6. Course Quality Standards
Sellers must ensure that:
Course descriptions are accurate.
Learning outcomes are clearly stated.
Materials are relevant and up to date.
Students receive access to the content advertised.
ClearLevel may remove low-quality, misleading, or incomplete listings.
7. Pricing
Sellers may set their own pricing, subject to platform policies.
ClearLevel reserves the right to:
Offer promotional discounts
Run marketing campaigns
Provide coupons or offers
Adjust displayed pricing where necessary
as part of platform-wide promotions.
8. Orders and Payments
Payments shall be processed through ClearLevel-approved payment gateways.
Seller payouts shall be made after:
Successful order completion
Applicable refund periods
Verification procedures
ClearLevel reserves the right to hold payments in cases involving disputes, fraud investigations, chargebacks, or policy violations.
9. Refunds and Disputes
Students may request refunds in accordance with the ClearLevel Refund Policy.
ClearLevel shall have final authority regarding refund eligibility, fraud investigations, and dispute resolution.
Any refunded amount may be deducted from future seller payouts.
10. Taxes
Sellers are solely responsible for:
GST compliance
Income tax obligations
Invoicing requirements
Regulatory filings
ClearLevel shall not be responsible for any tax liabilities of the seller.
11. Reviews and Ratings
Students may submit ratings and reviews.
Sellers may not:
Manipulate reviews
Offer incentives for positive reviews
Submit fake reviews
Harass students regarding reviews
Violations may result in account suspension.
12. Marketing and Promotions
ClearLevel may use course titles, descriptions, logos, instructor profiles, and promotional materials for marketing purposes.
Such use may include:
Website promotions
Social media campaigns
Search engine advertising
Email marketing
Affiliate marketing
13. Account Suspension and Termination
ClearLevel reserves the right to suspend or terminate any seller account for:
Policy violations
Fraudulent activity
Misrepresentation
Copyright complaints
Excessive refund requests
Student complaints
Illegal activities
No compensation shall be payable for account termination resulting from policy violations.
14. Limitation of Liability
ClearLevel acts solely as a technology marketplace platform.
ClearLevel shall not be liable for:
Loss of profits
Business interruptions
Data loss
Student performance outcomes
Seller revenue expectations
Third-party actions
The seller agrees to use the platform at their own risk.
15. Indemnification
The seller agrees to indemnify and hold harmless ClearLevel, its owners, employees, partners, and affiliates against any claims, damages, losses, liabilities, legal costs, or expenses arising from:
Uploaded content
Intellectual property disputes
Misrepresentation
Regulatory violations
Seller conduct
16. Modifications
ClearLevel may modify these Terms at any time.
Continued use of the platform after updates constitutes acceptance of the revised Terms.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India.
Any disputes shall be subject to the exclusive jurisdiction of the courts located in Kolkata, West Bengal, India.
